On 2 October 2024, the European Securities and Markets Authority (ESMA) posted on its website an answer to a question on the status of crypto-asset service providers that benefit from the transitional periods established under the #MiCA Regulation.
ESMA has specifically focused on the question of whether entities benefiting from the transition period should be treated as crypto-asset service providers or as virtual currency service providers, in line with the existing classification in national law. ESMA clarified that these entities do not have the status of crypto-asset service providers, as this status is only granted to entities that have been duly authorised or notified to the competent supervisory authorities.
